Services

In consideration of the services, information, and support received already or that you hereafter receive from Charlotte Kanyi/BirthEssence, you hereby hold her harmless and any related entities from any and all liability in consequence of such services, information and support given. You release and waive all claim for damage, as a result of such services, information and support. This release shall be effective and binding upon Charlotte Kanyi’s heirs, next of kin, executors, administrators and assigned. This waiver and release comes into effect on booking of any service provided by Charlotte Kanyi and booking of any service is an understanding that this waiver and release and all other terms and conditions on this page have been read in their entirety and understood. You understand that you are waiving certain legal rights that you or your heirs, next of kin, executors or administrators otherwise may have had.

Medical Disclaimer

Charlotte Kanyi is not a medical doctor or psychology professional and does not provide medical advice , diagnose illness, disease or any other physical or mental disorder or prescribe medical treatment nor recommend that you discontinue with any current medicines you may be taking. Charlotte Kanyi's services are not a substitute for a medical or psychological examination. It is recommended that you see a licensed medical professional for any ailments that you may be experiencing or any concerns that you have and no assurance or guarantee has been provided as to the results of the treatments and services you receive at BirthEssence and by Charlotte Kanyi.

Furthermore, Charlotte Kanyi is not a licensed financial advisor, marriage counsellor or legal practitioner ( lawyer/solicitor or other legal title) nor does she claim to have any specific professional qualifications of other kinds not listed here. Charlotte Kanyi is acting as a qualified and certified Journey Practitioner, Non Personal Awareness Practitioner, Compassion Key Practitioner to Master Level, and Reiki Practitioner to Level 2 ( Usui tradition) She is also certified in Thai massage, Holistic Oil Massage and Pregnancy Massage. Recorded Content and Images (Video/Audio Release)

By engaging and participating in recorded content such as but not limited to participating in Group Programmes or online workshops:
You authorise Charlotte Kanyi/BirthEssence to record your voice and /or image ( photograph or video) in any events or calls you attend ( other than private 1on1 sessions where your permission to be recorded will be sought in each session and those recordings will remain private unless you give specific written permission to the contrary) You authorise Charlotte Kanyi/BirthEssence to use, edit, copy, exhibit, distribute and use any video(s) or photograph(s)/image(s) of you for any lawful purpose. The authorisation you provide herein extends to all languages, formats, and media that have been discovered now or will later be discovered.

Furthermore, you waive your right to approve and/or inspect a product where you appear or your likeness appears. You waive all and any rights to all royalties or any other compensation in any form when it comes to the use of the recorded content/images. You release Charlotte Kanyi /BirthEssence from any libel, slander, invasion of privacy or any other claims. You release Charlotte Kanyi /BirthEssence from any liability, petitions, and causes of actions caused by you or by your heirs, executives or any other party and will hold Charlotte Kanyi / BirthEssence harmless.

Please note, all Live online (Zoom) events are recorded.

1on1 Sessions

Birth Confidence /Heal Your Birth Story/Transformation sessions and all 1on1 sessions offered by Charlotte Kanyi/BirthEssence last approximately one hour unless otherwise stated. There is some leeway of 15 minutes either side. The slight flexibility in length allows for the session to reach a natural completion of what we are working on.

Packages of 6 or 7 or more sessions are valid for 12 months from booking date (unless stated on registration page or in writing otherwise)and all sessions not taken during this 12 month period will be forfeit. Where packages are paid in full, sessions can be taken any time during this 12 months period at your discretion. Where packages are paid monthly, sessions are to be taken monthly on a pro rata basis. Bespoke packages will also be subject to a maximum length of time that will be agreed on at the time of booking.

Group Programmes -dates

Charlotte Kanyi/BirthEssence reserves the right to change dates and/ or times from the originally advertised and expected dates and times. I understand that there are no transfers from one group program to another group program. Any such changes will not be grounds for a full or partial refund for any programmes, events or other services purchased that these rescheduled calls and/or events are included as a part of.
Charlotte Kanyi/BirthEssence makes every effort in good faith to keep to the originally advertised and/or originally expected dates and times. If such changes are necessary they will be communicated as far in advance as possible to the email address used to register for the event, programme or service.

Payment Plans
Some programmes and services may be purchased with a payment plan. These payment plans are not a subscription that can be cancelled at any time but a pre-authorization of a fixed number of payments at a fixed amount. You will remain liable for all of these payments regardless of whether you withdraw from the course or for any other reason.

Cancellation/Refund Policy

Unless specifically advertised and highlighted on a registration page, checkout page or during an information call, there are no refunds or partial refunds on any programmes, private 1on1 sessions, packages of 1on1 sessions, or other services offered By Charlotte Kanyi/BirthEssence. There are specific exceptions to this rule listed below.
All cancellations must be submitted in writing.

For single sessions: If your cancellation is received 48 hours or more in advance you may receive a full refund or transfer your booking to a later date. If you do not send advance written notice of your cancellation, if you do not attend, or if you leave prior to the conclusion of your session. your payment is non-refundable and non-transferable.
For 1 on 1 packages: All cancellations must be received in writing. For a full refund that notice must be a minimum of 48 hours before the first scheduled session. Any fees incurred by third parties such as paypal may not be refunded. If you have not received prior sessions from Charlotte Kanyi/BirthEssence and after the first session you decide this package is not for you, you may cancel and will receive a partial refund minus the value of the first session (calculated at the single session rate and an admin fee currently set at £15. If you do not attend any session, or if you leave prior to the conclusion of any session, your payment is non-refundable and non-transferable and you lose that session.

If you do not attend any 1on1 session or are more than 15 minutes late for any session, whether that is a single session or is part of a package or group course, it will be considered a no show. In which case you lose your session and will not receive a full or partial refund for the session or for the programme the session was included with if it was included as part of a group programme. Furthermore if you are participating in a group programme and are late or miss any of the live calls you will not be entitled to a full or partial refund for any reason.

Charlotte Kanyi/BirthEssence makes two exceptions to the 48 hour rule. 1) for birth professionals/other professionals on call , including Doulas and Midwives provided they inform Charlotte Kanyi at point of booking that they will be on call and immediately that they are called to a birth. The session must then be rescheduled within 5 days. 2) for pregnant people who go into labour within the 48 hour period, who are then permitted to reschedule providing they inform Charlotte Kanyi when they go into labour.
Should your baby arrive earlier than expected you may transfer any remaining sessions to the postnatal period up to and including 6 months after your original EDD or within the original 12 months booking limit, whichever is the later date. In the sad and unfortunate event that you miscarry you may either transfer the sessions to a later date or towards another package or you would in this case be entitled to a partial refund on a pro-rata basis following the rules outlined above.

Communities

Participants of any communities created , owned or managed by Charlotte Kanyi /BirthEssence including but not limited to Facebook Groups and Whatsapp groups must follow all the guidelines of that group. These guidelines will be clearly communicated and posted inside of these groups. Violation of any of these guidelines may result in removal from that group/community and/or all of the online communities owned or managed by Charlotte Kanyi/BirthEssence. This is not grounds for a full or partial refund of any programme, course or other service connected to that group.

Depending on the violation and on Charlotte Kanyi’s discretion the participant may receive one or two warnings and given opportunity to come into alignment with the stated guidelines before removal takes place. However, in some circumstances with violations of a specific nature or that break any laws, Charlotte Kanyi reserves the right to remove a participant without warning at any time and for any reason. Charlotte Kanyi has sole discretion on how to handle community guideline violations.

Examples of behaviours that would result in removal from the community include but are not limited to sharing of other people’s personal information and story that is shared during live calls, and personal attacks and rudeness on group members or Charlotte Kanyi.

Charlotte Kanyi, BirthEssence, Birth Confidence, and Birth Transformation all relate to Charlotte Kanyi as a 'Sole Trader' business entity. We offer a range of Holistic Services including Pregnancy Massage, Reiki, 1:1 Sessions , group courses and packages of all treatments and sessions.
